TERMS AND CONDITIONS
1. Once allotted and agreement signed, the PRICES ARE FIRM
2. Cost of Stamp paper, Registration charges, Legal and miscellaneous expenses with the registration of individual share in land are to be borne by the purchasers. In case any additional stamp duty is claimed by the registration department, the same has to be borne by the purchaser.
3. Other expenses to be borne by the client include all local taxes, Service tax and VAT as applicable, Kerala Building Tax, Construction Workers Welfare Fund, Provident Fund Contributions or similar social security fund contribution, if any applicable or made applicable during pendency of the contract or after its completion in relation to this project, other statutory payments in respect of the construction work carried out. KSEB Deposit and cabling charges, Monthly Maintenance Deposit Advance, cost of transformer and generator (common) and the charges for Extra works, if any, as referred to/ specified in the agreement to be executed on allotment.
4. The plans are not drawn to scale and are included only for the purpose of identification. The measurements shown in the plan are indicative and may vary. Furniture layout is only an indication for space utilisation. All measurements and specifications shown in the brochure are subject to minor variations without specific or general notice. All such variations / alterations shall be purely at the discretion of the Builder.
5. In case, the project is not taken up due to any reason, the advance application money of the applicants would be refunded with simple interest @ 6% till refund.
6. No modification / changes shall be permitted in the specification.
7. The allotment shall be confirmed only at the remittance of the full booking amount on or before the stipulated date intimated by Builder, falling which this application shall stand cancelled and the application money will be re-funded only after re-allotment to another party and 10% will be deducted as expenses and damages.
8. In case of cancellation within 3 months after booking the Client is liable to pay the expense which company bares and damage will be recovered from the client. The booking amount will not be refunded in case of cancellation after 3 months.
9. All payments should be made by DD / Local Cheques in favour of M/s Empire Group payable at Trivandrum, Kerala, India. For NRI, all payments should be made only through their NRE / NRO Accounts.
10. This application is subject to confirmation by the way of a letter of allotment from the builder. The builder reserves the right to accept or reject the application. The application will not confer any contractual rights on the applicant.
11. All transactions are subject to Thiruvananthapuram jurisdiction only.
